Introduction

These Terms & Conditions apply when you use the Perth Garden Magic website, request a quote, make a booking or engage us to provide gardening or related outdoor maintenance services.

By using our website, requesting a quote or booking a service, you agree to these Terms & Conditions.

Services

Our services may include lawn mowing, edging, trimming, blowing, weeding, garden clean-ups, pruning, hedging, green waste removal, gutter cleaning, pressure cleaning and other related outdoor maintenance services, depending on what is agreed in your quote or booking.

Only the services specifically agreed in writing, by message, email, invoice or quote are included. Any extra work may require a revised quote or additional charge.

Quotes

We may provide quotes based on photos, videos, written descriptions, phone conversations or on-site inspections. Photos and descriptions must be accurate and current.

Quotes are based on the information available at the time. We may revise a quote if:

  • the property condition is materially different from the photos or description provided;
  • the work area is larger, more overgrown, unsafe or difficult to access than expected;
  • extra work is requested;
  • green waste, tip fees, parking costs, access issues or specialist equipment are required;
  • weather or site conditions affect the time or method required to complete the job.

Unless stated otherwise, quotes are obligation-free and valid for 14 days.

Bookings and Scheduling

Bookings are subject to availability, weather, site conditions and confirmation by us. We may reschedule a booking if weather, safety, illness, equipment issues, traffic, access problems or other circumstances make it unreasonable or unsafe to complete the service at the scheduled time.

If you need to reschedule or cancel, please give as much notice as possible. If a booking is cancelled late, we may charge a reasonable fee if we have already travelled, allocated time, purchased materials or incurred costs for the job.

Customer Responsibilities

You are responsible for:

  • providing accurate information about the property and requested services;
  • ensuring we have safe and reasonable access to the work area;
  • unlocking gates and securing pets before we arrive;
  • removing toys, hoses, furniture, fragile items, animal waste, loose objects and other obstacles from the work area;
  • telling us about hidden pipes, irrigation, cables, drains, reticulation, sprinklers, lighting, fragile plants, hazards, asbestos or other risks;
  • obtaining any required permission from owners, tenants, neighbours, strata, body corporate or other parties;
  • ensuring children, pets and other people stay clear of the work area while services are being performed.

We are not responsible for delays, incomplete work or additional costs caused by inaccurate information, unsafe access or failure to prepare the work area.

Access to Property

If you give us access instructions, keys, codes or permission to enter the property when you are not present, you authorise us to enter the agreed areas for the purpose of completing the booked service.

You are responsible for ensuring that access is lawful, safe and appropriate.

Green Waste and Rubbish

Green waste removal is included only if stated in the quote or booking. Otherwise, cuttings and green waste may be placed in your green waste bin or left neatly on site.

Tip fees, excess waste, contaminated waste, general rubbish, soil, rocks, rubble, hard waste or hazardous materials may incur additional charges or may be excluded.

Payment

Payment is due on completion of the service unless otherwise agreed in writing or stated on the invoice.

We may require a deposit, upfront payment or staged payments for larger jobs, materials, subcontracted work or recurring services.

If payment is late, we may pause further services, cancel future bookings, recover reasonable debt collection costs and charge any applicable fees permitted by law.

Cancellations, Delays and Changes

We understand that plans change. Please contact us as soon as possible if you need to cancel, reschedule or change a booking.

We may cancel, stop or refuse work if:

  • the site is unsafe;
  • there is aggressive behaviour, abuse or harassment;
  • payment is overdue;
  • the requested work is outside our capability, equipment, licence, insurance or legal requirements;
  • weather or property conditions make the work unsafe or unsuitable.

Weather and Seasonal Conditions

Gardening and outdoor maintenance are affected by weather and seasonal conditions. Rain, heat, wind, wet soil, dry lawns, fire risk, poor visibility or slippery surfaces may affect scheduling, the finish, or whether a service can be completed safely.

We will take reasonable care, but we cannot guarantee a particular lawn or garden result where conditions are affected by weather, soil quality, irrigation, pests, disease, previous maintenance, plant health or other factors outside our control.

Weeding, Herbicides and Chemicals

Where weed control, herbicide or chemical treatment is requested, we will only perform work that is lawful, suitable and within our capability. When a licence, permit or authorised person is required, the work will only be done by appropriately authorised persons.

You must tell us about pets, children, sensitive plants, edible gardens, ponds, allergies, health concerns or other issues that may be affected by chemical use.

We do not guarantee that weeds will not return. Weed regrowth can occur due to seeds, weather, soil conditions, watering, neighbouring properties and other factors outside our control.

Plants, Lawns and Living Materials

Plants, lawns and trees are living materials and may respond differently to mowing, pruning, trimming, weather, watering, pests, disease and soil conditions.

We will take reasonable care when performing services, but we do not guarantee plant growth, flowering, recovery, weed eradication, pest removal, lawn health or long-term results unless this is expressly agreed in writing.

Damage, Hidden Items and Pre-Existing Conditions

Please tell us about fragile, hidden, buried or valuable items before work begins. This includes reticulation, irrigation, cables, pipes, drains, garden lighting, ornaments, edging, low fixtures, uneven paving, loose stones, glass, tools and other hazards.

We are not responsible for damage caused by hidden, fragile, unsecured, poorly installed, pre-existing or undisclosed items, except where the damage is caused by our failure to take reasonable care.

If damage occurs, please notify us as soon as possible and give us a reasonable opportunity to inspect and respond.

Photos, Videos and Before-and-After Images

You may send us photos or videos so we can assess the work and provide a quote. We may take before-and-after photos for job records, quality control, quoting, insurance or dispute purposes.

We will not intentionally publish identifiable images of people, children, private information, number plates or sensitive areas without consent. We may use non-identifying before-and-after images for marketing unless you ask us not to.

Safety

We may refuse, stop or reschedule work if we consider the job unsafe. This includes unsafe weather, unstable surfaces, aggressive animals, hazardous materials, electrical risks, working at heights, dangerous trees, poor access, suspected asbestos, sharps, biohazards or other risks.

Some work may require a specialist contractor, arborist, electrician, plumber, builder, pest technician or other licensed person.

Australian Consumer Law

Nothing in these Terms & Conditions limits, excludes or modifies any consumer guarantees, rights or remedies that cannot be excluded under the Australian Consumer Law or other applicable laws.

Where permitted by law, our liability is limited to resupplying the relevant service or paying the cost of having the relevant service supplied again.

Website Use

The information on our website is general information only. We try to keep it accurate and current, but we do not guarantee that all information is complete, error-free or suitable for your specific circumstances.

You must not misuse our website, attempt to interfere with its security, copy content without permission or use it for unlawful purposes.

Third-Party Links

Our website or messages may contain links to third-party websites, platforms or services. We are not responsible for the content, security, privacy practices or availability of third-party websites.

Reviews and Testimonials

If you provide a review, testimonial or feedback, you allow us to use it for marketing unless you tell us otherwise. We may edit reviews for length, spelling or clarity, but we will not knowingly change the meaning.

Disputes and Complaints

If you are unhappy with a service, please contact us as soon as possible and provide details, photos and any relevant information. We will review the matter and try to resolve it fairly.

You must give us a reasonable opportunity to inspect and respond before arranging third-party rectification work, unless there is an urgent safety issue.

Changes to These Terms

We may update these Terms & Conditions from time to time. The updated version will be posted on our website with a new “Last updated” date.

Governing Law

These Terms & Conditions are governed by the laws of Western Australia. The parties submit to the courts of Western Australia and any courts entitled to hear appeals from those courts.
